Companies told to improve REACH dossiers

Some 86% of the 400 REACH registration dossiers for chemical intermediates evaluated by the European Chemicals Agency (ECHA) so far have failed to demonstrate the applicants' eligibility for reduced regulatory requirements, it has said.

This seems to be because of confusion among companies over the exact definition of an intermediate. Intermediates are subject to slimmed down registration rules and lower registration fees under REACH as long as registrants can show they are produced and used under strictly controlled conditions.The chemicals industry had been working to a relatively broad interpretation of the definition but it was tightened substantially by ECHA guidance finalised last summer.

Many registrants have failed to prove that their substance is an intermediate or to provide evidence of sufficiently strict controls, ECHA says, urging them to correct their submissions as soon as possible. The mistakes will otherwise be addressed through the dossier and substance evaluation process but this could take some time. Follow Up: ECHA press release plus intermediates guidance (2010)
